I heard this ACT is voting on March 2 by senete members, (PHD students directly change to GC), even it pass tomorrow, how long it will become a law?Whether it needs to be passed by congress next?Is it possible to become a law before June?

It has to be receipt date FIFO, but can never say how USCIS will processes.
With my experience from Backlog Elimination Center's, USCIS works using a pure random function that gets seeded randomly from congress.
Please let me know if 140 processing times is based on receipt date or notice date?
I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

That requirement is only for foreign passport holders travelling on visa/or visa waiver.
Us citizens are required tp present a non-expired passport, it does not say how long the passport needs to be valid for

I applied for H1 on Oct 10 2010. I got an RFE - (relatively benign - proof of labor cert filing) on Feb 22. My attorney responded and they changed the status to RFE Response Review on March 3rd. Unfortunately, I'm planning to go to India on the 26th.
- Would upgrading to Premium help at this time?
- What is the typical response time between RFE response review and decision?
btw, this application was processed in the Vermont Service Center.

Since H1 is for 6 years, you can extend for another year without filing I-140. You can apply for renewal within 180 days before expiry.

one of my friend worked here on L1 for couple of years for employer A.
then he got a H1 approved effective from Oct'07, with employer B.
but, he did not actually start working under employer B on H1 (payroll) until Mar'08.
he continued working under employer A on L1 ( has paystubs without any break) until Mar'08 and then worked with employer B on H1.
now he did a cap-exmpt H1 transfer to employer C, got H1 apporved and they are filing for GC labor PERM petition.
question is, while providing his previous employers info in the PERM petition,
can he say that he worked with employer A on L1 until Mar'08, even though his H1 with employer B is effective from oct'07?

yes. you cannot file AoS while out of country. you can file for yourself, but will have to file for the dependent/s when they return.

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

My current status is
I currently work for Company A (on H1B) and Company B is processing my GC (EB2, I140 approved; I485 in process) .
This month, I found a new job with Company C which I have to join on EAD (they don't do H1Bs). Also, in this month's bulletin, my PD became current. I had a few concerns/questions
1) Could the change in employment trigger any flags since I am changing companies and this is a future employment GC case (though its almost 3 years since the I-485 was filed)
2) What do you suggest I do since its so close? I waited all this time just not to complicate things (and remain on H1) but then as soon as have to start work on EAD, the date also becomes current (which I am definitely very happy about ) but now since both these events are so close, I am not sure what to do.
3) What other things are there to keep in mind in case of a future employment case?

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise.
