Hi,
My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?

Hi,
My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.
I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.
Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

Consider a consultant-only company where all employee work on client projects and all got EAD and can change employer anytime they want. What happens if everyone leave the company after 180 days and you (and few other) still continue. As this will have great impact on company balance sheet how this may effect final GC approval of those still continue? Most of us will have to wait 3-4 years before we get GC approved. Can it cause any problem or RFE? Or I-140 approval must be enough to show that employer is able to support the employee after GC approval. Just a thought.

My daughter has joined in a medical program in India and she has to return to US after 4 years to continue her studies. Her 485 is in process and she has stamped H4 upto 2012 ( 3 years from now). I am trying to find out the best strategy to get her here after 4 years if we dont get GC prior to H4 stamping expiry.
Should I continue to apply her EAD and Advance parole whenever she visits US (She will come to US atleast once every year)? Or Can I apply for her EAD and Parole just before the expiry of her h4 stamp (That is after 3 years)? Please advise.

If my priority date is current based on March visa bulletin, till what date can I file for my 485? Do I have time until end of April?
You can file anytime after your dates are current.. Just don't take too long though, Remember if the dates retrogress again, then might get out of luck! Again!! So file it right away if you can...

My wife got H1B approved in this year cap with validity date from October 1 2009. She is going to India for vacation during August 2009 and planning to go for H1B stamping.
My question is, whether she can go for stamping before October 1, 2009 which is the start date mentioned in I797 or she should go for stamping only after October 1,2009 ??

I had applied EAD back in 2009.
I received my EAD which was valid from 06/02/2009 to 06/01/2010.
I had applied 485 back in August 6,2007.
So here are the questions:
1) Some of the instruction says, we should not pay for EAD application if we applied on or after 30 July 2007 though I applied in 2009 with application fee of $375.
Should I get back the above filling?
2) Why the EAD was issued for 1 year instead of 2 years for the first time?
3) If I apply now should I file with application fee? Because some instruction says that I donot have to send filing fee as this is a renewal.
4) Can I file electronically?
5) Should I file for EAD to Nebraska office where I filed 485 back in 2007?

Hello
I am on Advance Parole (AP) and I need to travel to Europe multiple times (at least 3 times) in the next 2-3 months. My new AP has been approved and it is in transit. Last year when I applied for AP, I had received two copies of the AP. Now since I will be making multiple trips, do I need to apply for multiple copies of the AP? I am asking since my understanding is that I will have to surrender one copy of the AP at the entry point every time I come into US.

My PD is 09/2002. I have already renewed EAD for 3 times. Still I have been using my H1, not on EAD. Due to lot of expenses, I don't want to renew EAD again. Current EAD is expiring in September. Is that okay? or better renew? Thanks.
