My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.
My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
PLEASE HELP!!!

All,
Over the past few days we have been successful in getting good media attention BUT except for NYT, the coverage has not focused on the issues that are relevant and will draw the attention of the policymakers. I think the media drive should focus on getting the following issues highlighted:
1. Lapse in protocol when issuing green cards
a) Green cards issued WITHOUT security clearence
b) Green cards issued to those whose PD was NOT current in June
2. Obvious intent to NOT accept applications in July so that they can receive the same with a higher fee in the future. This at the cost of making a mockery of hundreds of thousand of hopeful legal immigrants
I think the media drive should focus and highlight the above and other key issues rather than merely reporting on the sequence of events. Please share your thoughts and add to the list above

I just got my labor cleared. EB3.
I need to get the I140 processed
Any idea how much time it generally takes for this to process.
The reason I'm asking is because my h1 needs to be processed in April and if this I140 gets cleared before that, I can get my h1 extension for 3 years.

Once you file it usually take 1-2 months.But you have premium processing for I140 now,you can have result in two weeks.So don't worry ..just talk to your attorney.

I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).

On July 2, 2008, a US Federal District Court in California entered an order requiring that the USCIS pay Mr. Asghar Shirmohamadali, the plaintiff in a Writ of Mandamus (WOM) law suit against the USCIS, around $25,500 in attorney fees and $1,000 in other costs incurred during the suit. In addition, the Court had previously ordered the USCIS to adjudicate Shirmohamadali�s pending I-485 case within 30 days.

Hi All,
We have sent AOS, EAD and AP applications for my wife and me on August 7th. So far, we have received receipt notices for EAD, AP and AOS for my wife only with Notice Date of September 17th. To my surprise the Priority Date field is left blank on all the receipt notices. Just wanted to check with others who have received their spouse's receipt notices if this is usual and nothing to worry about.

A little out of the box thinking. There are some useful ideas here even if there are many practical questions on how the plan would work. For one, is a highest bidder system necessarily the best indicator of which employers are most deserving of securing visas. Should a school system desperate for math teachers lose out on securing a visa just because it has a much more limited budget than a major corporation? yes, you can add her anytime before the approval of your I485 (3rd stage of the GC process). You havent mentioned EB1/2/3 but if its EB2 or EB3, stage 3 is several years away for you, and you can always add her before you apply for the final stage. Good luck!

I am a Java Developer and I think my company would have filed my labor as a Programmer Analyst. Now I am planning to change my career into SAP functional analyst in financials. I even got a offer from a client and I think their job title and description definitely different.
1) Once I leave my current employer, should I need to work on same job profile or only at the time of GC interview I should have a offer from any employer with same job title & description? (assuming GC will take another 2 or 3 years for me to get and If I work these 2 or 3 years on different job title & description and produce a offer letter with same job title & description from a new employer at the time of GC interview)
If later is correct, then I can produce a offer letter with same job title & description from a new employer.

You have to return both I-94's while ticketing ie before exiting and while entering at POE IO will give you new I-94 based on AP as Paroled AOS pending..
Ofcourse keep your copy of I-94 from your H1 Extension I-797 approval notice.

My cousin was in the same situation last year. She got the passport with VISA stamp in 2 weeks.
